These Terms govern your use of codenvibeit.com and any services you purchase from CodenVibe IT LLC ("CodenVibe", "we", "us", "our").

By accessing this website, submitting an inquiry, or completing a purchase, you agree to these Terms and our Privacy Policy.

  • ●All services are owned, operated, and fulfilled by CodenVibe IT LLC
  • ●Payments and recurring subscriptions are processed securely through Stripe

If you do not agree to these Terms, do not use this website or purchase our services.

Services offered through this website may include, but are not limited to:

  • ●Monthly care plans (hosting, maintenance, SEO, and support)
  • ●Add-ons and custom work quoted separately
  • ●Free demo or consultation requests submitted via forms or WhatsApp

Each package or plan is governed by the scope, limits, and pricing shown on the relevant page at the time of purchase or written agreement.

Use of This Website

  • ●Submitting a lead form or contacting us does not create a binding contract until a written quote or payment is accepted.

Subscription Billing & Payments

  • ●One-time website packages are charged once unless a separate written agreement states otherwise.
  • ●Monthly and yearly care plans are recurring until canceled.
  • ●By subscribing to a recurring plan, you authorize CodenVibe IT LLC to charge your payment method each billing cycle through Stripe.
  • ●Pricing, included hours, and deliverables are those shown on the package or care plan page at purchase.
  • ●All payments are processed securely by Stripe. We do not store full card details on our servers.

Cancellation Policy

  • ●You may cancel your subscription at any time through Stripe's billing portal or by contacting billing support.
  • ●Cancellation stops future billing only.
  • ●Access to services remains active until the end of the current billing period.
  • ●No partial refunds are issued for unused time within a billing cycle.

Refund Policy

Unless explicitly stated in writing:

  • ●One-time website deposits or package fees are non-refundable once work has started, unless stated in writing
  • ●Monthly care plan fees are non-refundable for the current billing period
  • ●Yearly care plan fees are non-refundable after the billing date
  • ●Refunds may be issued only at our discretion for duplicate charges, billing errors, or other exceptional cases

We do not provide refunds for:

  • ●Change of mind
  • ●Lack of usage
  • ●Misunderstanding of plan scope
  • ●Work already performed
  • ●Failure to cancel before renewal

Scope of Services & Limitations

Subscription plans cover only what is explicitly listed on the pricing page.

Unless included in your plan, subscriptions do NOT include:

  • ●New feature development
  • ●Website redesigns
  • ●Major migrations or rewrites
  • ●Custom software or SaaS development
  • ●Emergency or 24/7 support (unless stated)
  • ●Work exceeding included monthly hours

Any work outside the plan scope requires a plan upgrade or separate written approval and billing. Unused support hours do not roll over.

Fair Usage Policy

To maintain service quality:

  • ●Excessive resource usage (CPU, bandwidth, storage) may require a plan upgrade.
  • ●Repeated requests outside scope may result in service limitations or subscription review.
  • ●Abuse of infrastructure, systems, or support channels is not permitted.
  • ●We reserve the right to suspend or modify service if usage consistently exceeds reasonable limits.

Service Suspension & Termination

We may suspend or terminate services if:

  • ●Payments fail or remain unpaid
  • ●Fraudulent or abusive activity is detected
  • ●Terms are violated
  • ●Required cooperation or access is not provided

Service suspension does not waive outstanding payment obligations.

Client Responsibilities

You agree to:

  • ●Provide accurate billing and contact information
  • ●Maintain backups of your data where applicable
  • ●Provide required access credentials securely
  • ●Review plan details before subscribing

CodenVibe IT LLC is not responsible for issues caused by third-party services, plugins, hosting providers, or tools outside our control unless explicitly managed by us.

Third-Party Services

Our website and services may rely on third-party platforms including but not limited to:

  • ●Stripe (payments and subscriptions)
  • ●Google Tag Manager, Google Analytics, and Google Ads
  • ●Meta (Facebook) advertising and measurement tools, when configured
  • ●WhatsApp and other messaging platforms you choose to use
  • ●Hosting providers, cloud infrastructure, and integrations

We are not responsible for outages, limitations, or changes caused by third-party services.

Disclaimer of Warranties

Services are provided "as is" and "as available".

We do not guarantee:

  • ●Uninterrupted service
  • ●Error-free operation
  • ●Specific performance results
  • ●Business outcomes or revenue

Any uptime targets or performance statements are best-effort goals, not legal guarantees.

Limitation of Liability

To the maximum extent permitted by law:

CodenVibe IT LLC shall not be liable for:

  • ●Loss of data
  • ●Loss of revenue or profits
  • ●Indirect or consequential damages
  • ●Downtime caused by third-party providers

Our total liability shall not exceed the amount paid by you in the most recent billing cycle.

Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except where mandatory consumer protections in your jurisdiction apply.
